Version: 1.0
These Terms of Service govern your use of dungeonfire.com, shop.dungeonfire.com, play.dungeonfire.com, and other online services or checkouts controlled by DungeonFire LLC that link to these Terms.
By accessing the sites, creating an account, submitting information, purchasing a reservation or product, enrolling in a subscription, or affirmatively accepting these Terms, you agree to them.
The Privacy Policy, Return and Refund Policy, Shipping Policy, and any product-specific or promotion-specific terms presented before purchase are incorporated into these Terms.
DungeonFire LLC is the seller and contracting party for transactions that clearly identify DungeonFire LLC at checkout.

Tabletop Table is a sister company and a separate seller. A cross-promotion, referral, or link between DungeonFire and Tabletop Table does not make either company the seller of the other's transaction unless the checkout expressly states otherwise.
You must be at least 18 years old or the age of legal majority where you live to make a purchase or enter a binding agreement.
A minor may use the sites only through a parent or legal guardian who reviews and accepts these Terms and is responsible for the transaction.
You represent that the information you provide is accurate, the purchase is lawful, and you are authorized to use the payment method submitted.
DungeonFire LLC may revise these Terms prospectively. The version in effect when you complete a transaction ordinarily governs that transaction.
A product page, checkout disclosure, reservation offer, subscription disclosure, promotion, or other transaction-specific term may supplement these Terms. If a specific term directly conflicts with these general Terms, the more specific term controls for that transaction, subject to applicable law.
The Founding Flame Reservation is a one-dollar paid opportunity to qualify for the Founding Flame VIP Expansion associated with the planned DungeonFire Kickstarter campaign.
It is not:
No physical fulfillment is due merely because the reservation was purchased.
The reservation is refundable until the official DungeonFire Kickstarter campaign first becomes publicly available for pledging.
The official launch time is determined by DungeonFire LLC's campaign records and is measured in Pacific Time using the America/Los_Angeles time zone.
After launch, the reservation is nonrefundable except as stated in the Return and Refund Policy, where DungeonFire LLC approves an exception, or where required by law.
DungeonFire LLC will refund active reservations if the contemplated campaign is permanently canceled before launch or launches and closes without successfully funding.
To qualify for the Founding Flame VIP Expansion, you must:
DungeonFire LLC's order, campaign, payment, and pledge-manager records determine eligibility, subject to correction of documented errors.
Unless a later written offer states otherwise:
The contemplated Founding Flame VIP Expansion contains one Event card, one Item card, one Equipment card, one Trap card, one Action card, one Background card, and one Ancestry card.
The benefit is expected to be supplied with the qualifying Kickstarter reward or through the associated pledge-manager and campaign-fulfillment process. It is not ordinarily shipped as a separate one-dollar store order.
Prototype art, titles, wording, layout, balancing, finishes, packaging, and nonmaterial production details may change. DungeonFire LLC will not intentionally make a material reduction to the stated seven-card composition without reasonable notice and an appropriate remedy.
The Founding Flame VIP Expansion is not promised as permanently exclusive. DungeonFire LLC may later reprint, sell, bundle, modify, license, or otherwise make the cards or substantially similar content available.
Purchasing the reservation authorizes communications reasonably necessary to administer the transaction, including payment, refund, launch timing, qualification, identity matching, pledge-manager, fulfillment, security, and legal notices. General marketing consent remains separate and optional.
Kickstarter is a separate third-party platform. A Kickstarter pledge is a transaction governed by Kickstarter's terms, the DungeonFire campaign page, campaign updates, applicable pledge-manager terms, and mandatory law.
Purchasing a SHOPLINE reservation does not create a Kickstarter account or pledge and does not guarantee Kickstarter approval, platform availability, successful funding, a particular campaign duration, pledge price, reward content, stretch goal, manufacturing date, or delivery date.
DungeonFire LLC is responsible for its own representations and obligations, but it is not responsible for the independent operation, outages, account decisions, or policies of Kickstarter or another third-party platform.
The store may offer physical board games, expansions, card packs, miniatures, metal components, dice, sleeves, neoprene mats, books, art books, apparel, replacement parts, gaming furniture, gaming accessories, digital rulebooks, paid digital downloads, gift cards, memberships, subscriptions, wholesale products, preorders, and other items described on the applicable page.
The presence of a category in these Terms does not guarantee that the category is currently available.
Product-specific descriptions, safety warnings, age guidance, assembly instructions, care instructions, weight limits, and warranty terms form part of the transaction where displayed before purchase.
An automated order confirmation acknowledges receipt of your order but does not necessarily constitute final acceptance.
DungeonFire LLC may accept a physical-product order when fulfillment begins or when a separate acceptance notice is sent.
DungeonFire LLC may refuse or cancel an order before acceptance for legitimate reasons, including:
If DungeonFire LLC cancels a paid order, it will refund the amount collected for the canceled item, subject to the payment and refund provisions below.
Prices are displayed in the currency shown at checkout.
Unless expressly stated otherwise, prices do not include shipping, sales tax, VAT, customs duties, brokerage, import charges, or other government fees.
You authorize DungeonFire LLC and its payment providers to charge the payment method submitted for the item price, shipping, applicable taxes, duties collected at checkout, recurring charges you separately authorize, and other amounts clearly disclosed before purchase.
DungeonFire LLC may correct an obvious pricing, discount, tax, inventory, or description error before fulfillment. If an error materially affects an order, DungeonFire LLC may ask you to confirm the corrected terms or cancel and refund the affected transaction.
Payment providers may impose separate terms, fraud checks, currency conversions, or processing restrictions.
Products and promotions may be limited by inventory, customer, account, household, region, campaign, or purchase quantity.
DungeonFire LLC may limit, suspend, or cancel transactions that reasonably appear to involve bots, fraud, stolen payment information, circumvention of limits, abusive chargebacks, unauthorized resale, or conduct harmful to customers, providers, or the store.
Where practical and lawful, canceled paid quantities will be refunded.
DungeonFire LLC aims to describe products accurately, but photographs, monitors, prototypes, samples, renderings, and production units may differ in color, texture, finish, scale, packaging, or minor detail.
For products still in development, DungeonFire LLC may make reasonable nonmaterial changes to art, titles, wording, rules text, balance, packaging, components, manufacturing methods, and production details.
DungeonFire LLC will not intentionally substitute a materially inferior paid product or materially reduce an express composition without reasonable notice and an appropriate remedy.
A prototype, concept image, or estimated specification is not a guarantee that every depicted feature will appear in the final product unless expressly stated as final.
A product is a preorder only when the product page expressly identifies it as such.
Estimated production, shipping, or delivery windows are not guaranteed dates. Manufacturing, testing, freight, customs, port, warehouse, carrier, regulatory, and other events may cause delay.
If a material delay occurs, DungeonFire LLC will provide notice and any consent, cancellation, or refund choice required by applicable law.
The Founding Flame Reservation is not a preorder.
Unless a separate license states otherwise, a digital product is licensed to the purchaser for personal, noncommercial use and is not sold as intellectual property.
You may not reproduce, redistribute, publicly post, resell, sublicense, scrape, extract, or commercially exploit digital content without written permission.
Where applicable law requires it, immediate delivery of digital content may require your express consent and acknowledgment that beginning delivery can affect a statutory withdrawal right.
Gift cards may be used only as stated at purchase. They are not redeemable for cash except where required by law, may not be resold without permission, and may be canceled where obtained through fraud or unauthorized payment.
Expiration and fee rules, if any, will comply with applicable law and be disclosed before purchase.
If DungeonFire LLC offers a subscription or membership, the recurring price, billing frequency, renewal terms, minimum commitment if any, cancellation method, trial terms, and material restrictions will be displayed before enrollment.
By enrolling, you authorize recurring charges according to those specific terms until cancellation.
Cancellation stops future renewal charges but does not ordinarily create a retroactive refund for a completed billing period unless the offer states otherwise or law requires a refund.
DungeonFire LLC will provide legally required acknowledgments, renewal notices, price-change notices, and cancellation methods.
This section does not itself enroll you in a subscription.
Gaming furniture and oversized products may require assembly, installation, adequate access, suitable flooring, wall clearance, weight planning, or professional assistance.
You are responsible for following all instructions, safety warnings, weight limits, care guidance, and product-specific requirements. Do not modify, overload, misuse, or install a product in an unsafe manner.
To the fullest extent permitted by law, DungeonFire LLC is not responsible for injury or property damage caused by improper assembly, unauthorized modification, misuse, failure to follow instructions, or use beyond stated limits.
This section does not limit rights relating to a defective, unsafe, or misdescribed product or liability that cannot lawfully be excluded.
The Shipping Policy and Return and Refund Policy are incorporated into these Terms.
You are responsible for providing complete and accurate contact and delivery information. Delivery estimates begin after carrier acceptance, not necessarily on the order date.
Return eligibility depends on the transaction type. In particular:
You are responsible for maintaining accurate account information, safeguarding credentials, controlling access to your device, and notifying DungeonFire LLC promptly of suspected unauthorized activity.
DungeonFire LLC may suspend or restrict an account where reasonably necessary to investigate fraud, abuse, chargebacks, security risks, or violations of these Terms.
General marketing consent is optional and is not a condition of purchase.
You may unsubscribe from promotional email through the message link. Where you separately consent to marketing SMS, message frequency may vary, message and data rates may apply, and you may reply STOP to opt out or HELP for assistance.
DungeonFire LLC may send nonmarketing communications reasonably necessary to administer a reservation, order, account, warranty, product-safety issue, fraud investigation, or legal obligation.
A DungeonFire list may include a relevant Tabletop Table cross-promotion in the context of DungeonFire communications. This does not automatically subscribe you to Tabletop Table's separate standalone list.
A promotion may have eligibility rules, start and end dates, geographic restrictions, quantity limits, excluded products, non-stacking rules, referral requirements, or separate official rules.
Unless expressly stated otherwise:
You retain ownership of original content you submit.
When you voluntarily post a public review, rating, photograph, video, comment, or similar submission through our store or public community channel, you grant DungeonFire LLC a nonexclusive, worldwide, royalty-free, sublicensable license to host, reproduce, format, adapt for size or accessibility, display, distribute, and use that public submission for store operation, customer service, product improvement, and reasonable promotion.
You represent that you have the right to submit the content and that it is accurate, lawful, noninfringing, and not deceptive.
Private customer-service materials, damage photographs, and personal information are governed by the Privacy Policy and are not treated as general promotional content without separate permission.
Ideas, suggestions, and nonconfidential feedback may be used without obligation to compensate you, provided DungeonFire LLC does not publicly identify you without permission.
The sites and their content, including the DungeonFire and Dungeon Fire names, logos, artwork, characters, worlds, rules text, card designs, illustrations, photographs, videos, audio, copy, graphics, layouts, software, and other materials, are owned by DungeonFire LLC or licensed to it and are protected by intellectual-property laws.
Except for ordinary personal, noncommercial use of the sites and products, you may not copy, reproduce, modify, distribute, publish, sell, scrape, reverse engineer, train a competing model on, create derivative commercial products from, or otherwise exploit protected material without written permission.
Nothing in these Terms transfers ownership of DungeonFire LLC's intellectual property.
You may not:
The sites may link to or integrate with SHOPLINE, Kickstarter, Tabletop Table, Discord, social networks, payment systems, review platforms, creators, fulfillment providers, carriers, or other third parties.
DungeonFire LLC is not responsible for independent third-party content, availability, conduct, or terms. A link or integration does not necessarily constitute endorsement.
To the fullest extent permitted by law, the sites are provided on an as-available basis.
DungeonFire LLC does not warrant that:
Products remain subject to all express descriptions made by DungeonFire LLC and all nonwaivable warranties, guarantees, and remedies under applicable law.
Nothing in these Terms excludes liability for fraud, intentional misrepresentation, gross negligence, willful misconduct, personal injury caused by negligence where liability cannot be excluded, or another liability that cannot lawfully be limited.
To the fullest extent permitted by law, DungeonFire LLC and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost opportunity, loss of data, or loss of goodwill, arising from the sites or a transaction.
To the fullest extent permitted by law, the aggregate liability of DungeonFire LLC arising from a particular transaction will not exceed the greater of:
These limitations do not apply where prohibited by law or to liability that cannot lawfully be limited.
Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, the provisions apply only to the maximum extent permitted.
To the extent permitted by law, you agree to indemnify and hold DungeonFire LLC harmless from third-party claims and reasonable costs arising directly from your unlawful conduct, fraud, infringement of another person's rights, or material violation of these Terms.
This obligation does not apply to claims caused by DungeonFire LLC's breach, negligence, or unlawful conduct.
DungeonFire LLC is not responsible for delay caused by events outside its reasonable control, including natural disaster, war, civil unrest, epidemic, labor interruption, government action, port closure, customs delay, carrier disruption, cyberattack, utility failure, supplier interruption, or material shortage.
DungeonFire LLC will take reasonable steps to communicate and mitigate a material delay.
This section does not eliminate a mandatory obligation to provide a delay notice, obtain consent, cancel an order, or issue a refund.
Before filing a court action, you and DungeonFire LLC agree to make a good-faith effort to resolve the dispute by written notice and reasonable discussion for at least 30 days, except for a claim in small-claims court, a request for urgent injunctive relief, or a claim for which delay would cause material prejudice.
Send a dispute notice to play@dungeonfire.com and by mail to the address in Section 1. The notice should describe the dispute, relevant order or account, supporting facts, and requested resolution.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except that mandatory consumer law in your place of residence may still apply.
Subject to mandatory law, legal proceedings relating to these Terms must be brought in the state or federal courts located in Orange County, California, and the parties consent to that jurisdiction.
These Terms do not require mandatory arbitration and do not waive class-action or jury-trial rights.
If a provision is unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue.
A delay or failure to enforce a provision is not a waiver.
You may not assign a transaction or rights under these Terms without written consent. DungeonFire LLC may assign these Terms in connection with a legitimate merger, financing, reorganization, sale, or transfer of the business, subject to applicable law.
These Terms, the incorporated policies, and applicable transaction-specific terms constitute the agreement concerning use of the sites and the relevant transaction.
Headings are for convenience and do not change interpretation.
